Welcome to Hala Circus Arts! These Terms of Service (the "Terms") are the agreement between you and Hala Circus Arts ("we," "our," or "us") covering your use of halacircusarts.com (the "Site") and our classes, events, performances, and related services (together, the "Services").

By using the Site or Services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Site or Services.

1. Who Can Use Our Services

Our Services are intended for adults (the age of majority in your province or territory). Minors are welcome to participate with the consent and supervision of a parent or legal guardian, who agrees to these Terms on the minor's behalf.

2. Our Services

We offer circus arts classes, workshops, training, events, performances, and related products. Specific offerings, schedules, and pricing are posted on the Site and may change from time to time.

3. Accounts

If you create an account or register for a class or event, please keep your information accurate and your login details secure. You're responsible for activity under your account. We may suspend or close accounts if needed to protect our Services or community.

4. Privacy & Communications

Your privacy matters to us. Our Privacy Policy explains what we collect, how we use it, and your choices. By using the Site or Services, you agree to those practices and to receiving communications from us in accordance with Canadian anti-spam law (CASL). You can unsubscribe from marketing messages at any time.

5. Our Content

The content on our Site — including text, images, videos, logos, designs, and class materials — belongs to Hala Circus Arts or our licensors and is protected by copyright and trademark laws. Please don't copy, republish, or redistribute it without our permission.

6. How to Use the Site

We ask that you use the Site and Services respectfully. Please don't:

• Break any applicable laws.
• Infringe on anyone else's rights.
• Post or send anything harmful, threatening, abusive, harassing, or obscene.
• Disrupt the Site or try to access it in unauthorized ways (including bots or scrapers).
• Collect other users' information without their consent.
• Use the Site for commercial purposes we haven't approved.

7. Assumption of Risk

CIRCUS ARTS AND PHYSICAL ACTIVITIES INVOLVE INHERENT RISKS OF INJURY, INCLUDING BUT NOT LIMITED TO SPRAINS, FRACTURES, CONCUSSIONS, PARALYSIS, AND IN EXTREME CASES, DEATH. BY PARTICIPATING IN ANY HALA CIRCUS ARTS CLASS, WORKSHOP, EVENT, OR ACTIVITY, YOU ACKNOWLEDGE AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH SUCH PARTICIPATION, WHETHER KNOWN OR UNKNOWN, FORESEEABLE OR UNFORESEEABLE.

Participation requires a reasonable level of physical fitness, and you are solely responsible for determining whether you are fit and able to safely participate. Please follow all safety instructions and guidelines provided by our instructors and staff at all times.

8. Waiver and Release of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE HALA CIRCUS ARTS, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, INSTRUCTORS, VOLUNTEERS, CONTRACTORS, AFFILIATES, AND SUCCESSORS (COLLECTIVELY, THE "RELEASED PARTIES") FROM AND AGAINST ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, SUITS, COSTS, EXPENSES (INCLUDING REASONABLE ATTORNEY'S FEES), DAMAGES, AND JUDGMENTS OF ANY KIND OR NATURE WHATSOEVER, WHETHER IN LAW OR IN EQUITY, WHETHER KNOWN OR UNKNOWN, THAT ARISE OUT OF OR IN CONNECTION WITH:

• Your use of the Site or Services;
• Your participation in any Hala Circus Arts class, workshop, event, or activity;
• Any injury, illness, disability, death, or property damage you may suffer during or as a result of participation;
• The collection, use, disclosure, or processing of your personal information as described in our Privacy Policy and these Terms;
• Any communications sent to you by or on behalf of Hala Circus Arts;
• Any reliance on information provided on the Site;
• Any breach of these Terms by you; or
• Any other matter relating to the Site or Services.

This release applies regardless of whether the liability, claim, or damage arises from the negligence, gross negligence, or fault of the Released Parties, to the fullest extent permitted by law.

9. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS HALA CIRCUS ARTS AND THE RELEASED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEY'S FEES AND COURT COSTS) ARISING OUT OF OR RELATED TO:

• Your use of or access to the Site or Services;
• Your violation of these Terms or any applicable law or regulation;
• Your violation of any rights of any third party;
• Any content you submit, post, or transmit through the Site;
• Your participation in any Hala Circus Arts class, event, or activity.

This obligation continues after these Terms end or you stop using the Services.

10. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HALA CIRCUS ARTS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Some jurisdictions don't allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In those cases, our warranties are limited to the fullest extent permitted by applicable law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HALA CIRCUS ARTS OR ANY OF THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL HALA CIRCUS ARTS' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES EXCEED THE GREATER OF: (A) THE AMOUNTS PAID BY YOU TO HALA CIRCUS ARTS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes will be handled in the courts of Toronto, Ontario.

13. Resolving Disputes

If something goes wrong, please reach out to us first — most issues can be resolved quickly. You agree to contact us and give us at least thirty (30) days to work things out informally before starting any formal legal proceeding.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIMS OR DISPUTES SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

14. Photos and Video

We sometimes photograph or film at our classes, events, and facilities for promotional use (social media, website, marketing). By participating or visiting, you grant us permission to capture and use your image, likeness, voice, and performance in our communications. If you'd prefer not to be photographed or filmed, please let us know and we'll do our best to accommodate.

15. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on the Site, and your continued use of the Services means you accept the updated Terms. We'll do our best to highlight significant changes.

16. Miscellaneous

A few legal details:

• Severability: If any part of these Terms is found unenforceable, the rest still applies.
• Entire agreement: These Terms and our Privacy Policy are the full agreement between you and us about the Site and Services.
• No waiver: If we don't enforce part of these Terms right away, we haven't given up the right to do so.
• Assignment: You can't transfer your rights under these Terms without our written consent; we may assign ours as part of our normal business.
• Force majeure: We're not responsible for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, outages, government actions).
